RESIDENCE PERMIT FOR FAMILY REUNIFICATION IN POLAND

Working foreigners in the vast majority of cases have to travel to Poland to earn money for their family back home. And due to this circumstance, they miss their family members while in a foreign country.

And the Polish government has found a way out of such situations. After all, it is profitable for the state to have a huge number of happy and satisfied taxpayers in the person of foreigners who work for the benefit of Poland, developing the economy of the country. WHICH FAMILY MEMBERS ARE ELIGIBLE FOR THE REUNIFICATION PROGRAM?

You can join your card to your spouse, minor children (including adopted children), parents/children requiring guardianship for health reasons, and in some cases - common-law spouses.

Who is eligible for the family reunification program?

  • foreigners who have a residence card issued for at least two years;
  • foreigners who have a residence card or a residence card;
  • foreigners who have refugee status and on this basis are in the country;
  • foreigners who hold a blue card of high qualifications.

If a foreigner has any of the above mentioned documents, he/she can use the right to family reunification and bring his/her family to Poland.

UNDER WHAT CONDITIONS CAN I TAKE MY FAMILY TO POLAND?

The main condition for obtaining a family reunification visit card is the status of a family member of a foreigner who has a residence permit in Poland. Such status is confirmed by a marriage certificate, birth certificate of children.

Without these documents (necessarily translated into Polish) it is impossible to obtain a family reunification visa in most cases. Under what conditions can I take my family to Poland?

For how long can a family move?

If the reunification is made on the basis of an employment card of an employed foreigner, the family members who join this card will receive a temporary residence permit for a period not longer than the validity of the employment card.

If reunification takes place on the basis of the employment card or another document from the list indicated at the beginning of this article, the family members will receive their residence cards for a period of 3 years. They can be renewed thereafter.

OPTIONS FOR FAMILY REUNIFICATION IN POLAND

  • Reunification of husband and wife

This is the most frequent and common filing option.

Conditions for reunification: the husband (wife) has a residence card and they are officially married (there is a marriage certificate).

  • Reunification with children under 18 years of age.

Conditions for reunification: the parent legally works in Poland and joins his/her residence card to the children, who will be further educated in Polish educational institutions (kindergartens, schools, technical schools) or will be under the care of a contracted nanny.

  • Reunification of a couple in a common-law marriage (Związki partnerskie).

Conditions for reunification: the couple lives together, has a joint household, the conduct of which can be documented. It is necessary to provide the inspector with bills, receipts and other documents for the previous year, which show your joint spending, joint loans, rental agreement, where both people are listed and so on. This filing for reunification does not happen often, but there are still positive precedents.

Sometimes it is easier for a couple to get married rather than spend a year collecting various receipts and bills.

  • Reunification of children after the age of 18 with their parents. This item is rather an exception: applications for this option are rare but possible.

For example, reunification is possible if an adult young person works in Poland and has one parent in his/her home country who, due to his/her health condition, requires care and a guardian. In such a case, the child, having documented the parent's health condition, can submit a package of documents to join his/her card.

And vice versa: if a child over 18 years of age requires a guardian for health reasons, the parent can also add him/her to his/her residence card.

WHAT DOCUMENTS ARE NEEDED FOR REUNIFICATION?

To join your relatives to your residence card, you need to collect this list of documents for family reunification:

  • a rental agreement;
  • a contract from the employer with a salary, the amount of which will cover the family's living expenses. Polish law has defined the amount of 550 PLN per person as sufficient for living if the whole family plans to live under one roof. That is, a family of three living together will need an amount equal to the cost of rent + 550 PLN*3 persons.

*A little tip for our readers: if your salary is not enough to cover the amount required for the family, you can agree with the landlord to pay a lower rent.

  • medical insurance;
  • passport;
  • passport of the person the family member is joining;
  • PESEL number, if available;
  • marriage certificate translated into Polish;
  • child's birth certificate translated into Polish;
  • documents from the Polish educational institution where the child will study (kindergarten, school, lyceum, etc.) If the child is very young, it will be a contract concluded with a nanny.

You will also need to add to the application package a correctly filled out application form (vniosek), 4 document photos of 3.5*4.5 cm in size, and a receipt for payment of the stamp duty fee of 340 PLN.

How to fill in the application form for family reunification

What to do in case of refusal of family reunification?

The main reasons for refusals in the card:

  • Numerous mistakes were made when filling in the documents independently.
  • The purpose for which the residence card is issued does not correspond to reality (for example, there is no marriage certificate).
  • The foreigner has indicated an incorrect address for receiving correspondence from the migrant and, consequently, is unable to receive and respond to letters in time.
  • False, incorrect or incomplete information about the alien has been submitted in the documents.
  • The foreigner is entered in the SIS database and is prohibited to stay on the territory of Poland.
  • The foreigner is applying for a residence card while being in Poland illegally at the time of application.

If you receive a negative decisión, you can appeal against it within 14 days to the main Polish Office for Foreigners in Warsaw. If the appeal is granted, you will be required to remove the reason for the refusal (correct the documents, provide additional data, etc.)

It is important to remember that as soon as you receive a negative decision, you will not have an official permit to stay legally in Poland and you will be obliged to leave the country as soon as possible. Therefore, you should not delay in filing an appeal.

INSTRUCTIONS: HOW TO GO TO POLAND WITH YOUR FAMILY?

We will describe all the steps in two of the most common examples of family reunification that occur in our practice:

1 variant:

We have a family of three: husband, wife and child. The husband first went to Poland, got a job and, after some time, applied for an hour card from work. And now he wants to move his wife, who also plans to work (or study) in Poland, and the baby of three years old.

  • To enter Poland, the mom and the baby will need reasons to do so. The mom - an invitation to work or study, the three-year-old child - an invitation to an educational institution (kindergarten). Based on these invitations, mom and baby will get their visas.
  • Further, while the family members are legally in Poland on the basis of visas, it is necessary to start collecting and submitting documents for family reunification.
  • The main thing is to have time to submit the documents and get the red stamp before your visas expire. If everything has worked out - your documents have been accepted by the Uząd and the red stamps are in place, you can safely wait for your residence cards, officially staying in Poland.
  • At the end of the review of the case on your residence cards you receive a positive decision (decizia), pay a stamp duty of 50 PLN for the plastic card and, after a period of about a month, receive the card itself.

2 variant:

All family members want to move to Poland at the same time.

  • In this case, the husband and wife, as in the first option, need work invitations as grounds for opening visas, and the baby needs an invitation from an educational institution.
  • As soon as the parents start working, you can prepare a package of documents and apply for a visa together. If both parents work, then each should apply for a visit card on the basis of employment, and the child should be attached to the card, where the work contract has a higher salary.
  • If one parent works, he or she applies on the basis of employment, and the wife and child apply on the basis of family reunification.
  • We would like to remind you that in order to join a visit card, the amount of payment under the work contract of the holder of the visit card must cover the living needs of the whole family. Namely the amount of rent and 550 PLN for each family member, if the whole family plans to live under one roof. That is, for a family of three people living together, you will need an amount equal to the rent + 550 PLN*3 family members.
  • Then you submit all the collected documents to the UZOND in order not to miss the deadline for visas and, having received a red stamp, you calmly wait for the decision on your visa card.
